The Union Pacific is pleased to announce an amendment and expansion of our liability coverage of onions and potatoes shipped via rail. The following changes will be implemented immediately to better serve the needs of our customers. Claims Liability Clause Amendment/Expansion

Cars released after Friday, December 13, 2013 will be limited to liability for loss due to derailment, fire, theft and failure of the refrigeration unit to operate only.

Union Pacific will consider responsibility for product deterioration as a result of time on a case by case basis, providing a USDA product inspection was completed within 24 hrs of rail car loading and unloading . Claims consideration will be for transit delays of more than 7 days past the published transit time.

Union Pacific will not be responsible for product deterioration due to temperature variance when rail car temperature gauges and/or refrigeration unit control computer indicate the temperature was maintained between plus and/or minus five (5) degrees Fahrenheit of the requested unit set temperature.

The Union Pacific reserves the right, at their discretion, to further amend this liability provision at any time.
