Alameda Corridor Use Fee Increase - MITA Item 794

Dear Intermodal Customer:

In accordance with the ACTA agreement, Union Pacific has updated our Master Intermodal Transportation Agreement (MITA2), announcing the Alameda Corridor User Fee increase for 2013. This update can be found in MITA2 item 794, effective January 1, 2013. The MITA2 document itself can be referenced on our Website, MYUPRR.COM, under General Rules/Intermodal/Master Intermodal Transportation Agreement.

The ACTA agreement provides that increases will be effective January 1st of each year, and will be reflective of the year-over-year (October v. October) change in the Los Angeles County Consumer Price Index.

For your ready reference, the new Alameda Fees are outlined in below. Other details regarding the 2013 increase may be referenced in the MITA2 agreement item referenced herein.

A. Fees Effective January 1, 2013:

(1) Loaded Waterborne Containers:
   a. 22' or less $22.00 per container
   b. Greater than 22' and equal to but not greater than 44' $44.00 per container
   c. Greater than 44' but less than 48 ' $50.00 per container
   d. Equal to 48' but less than or equal to 52' $53.00 per container
   e. Greater than 52' $59.00 per container

(2) Empty Waterborne Containers:
   a. 22' or less $ 5.00 per container
   b. Greater than 22' and equal to but not greater than 44' $11.00 per container
   c. Greater than 44' but less than 48 ' $12.00 per container
   d. Equal to 48' but less than or equal to 52' $13.00 per container
   e. Greater than 52' $14.00 per container

(3) Non Waterborne containers (Load or Empty):
   a. 22' or less $ 5.00 per container
   b. Greater than 22' and equal to but not greater than 44' $11.00 per container
   c. Greater than 44' but less than 48 ' $12.00 per container
   d. Equal to 48' but less than or equal to 52' $13.00 per container
   e. Greater than 52' $14.00 per container
