To Our Customers,

Union Pacific's existing policy regarding resolution of grain claims on shipments moving subject to Carmack (UP 6007) is outlined below.

The underfill price of lost or damaged lading greater than 25 tons (see attached STCC list) will be defined as the closing Market price on the day Union Pacific notifies the customer (email, phone or fax) of the incident and the amount of loss. If notification occurs after 12:00 p.m. (Noon-CT) on the day of notification, the following day's closing price will be used. The Market price will be based on the appropriate futures price as published in the Wall Street Journal with the same terms and conditions of the shipment contract (i.e, purchase and delivery location, commodity grade, condition, basis and unit size of shipments, etc). The underfill price of lost or damaged lading 25 tons or less will be defined as the Contract price.

The following commodities apply under this policy:
01131, 01132, 01133, 01135, 01136, 01137, 01139, 01142, 01144, 01149, 2041952, 2041953, 2041979, 2041981, 20921, 20923.

If you have any questions please contact your Union Pacific representative.
