MITA Item 795: Rule 11 Shipments

Announcement Number: IM2018-278
Categories: International Rules and Provisions
Posted Date: August 24, 2018

Dear Premium Customer,

Union Pacific has seen a steady rise in the number of chassis pool providers attempting to bill Loup or Loup's carriers, our Union Pacific subsidiary responsible for managing cross town drayage moves in eastern gateway interchange points, for chassis per diem charges. As you are aware, while Union Pacific arranges and provides for the cross town drayage move, Union Pacific has not previously paid for the chassis charge nor do we intend to make a change to that practice.  While this has been previously stated in MITA, we are including clarifying language in the next MITA update.  Here is the current and amended language pertaining to MITA Item 795.

In the meantime, we request that you:

1) Ensure your respective teams are aware of Union Pacific's and Loup's role in cross town moves as the coordinator.

2) Ensure your respective team understands either your role as the Ocean Carrier or your customer's role (shipper role) to pay for the chassis per diem charges.

3) Ensure that your processes and communication with the chassis providers clarify to them that charges should be billed to your company or the shipper and not Union Pacific, Loup, or Loup's carriers.

Thank you for your prompt attention to this matter.

Sincerely,

Premium Marketing and Sales
