Settlement Information

If you are a current or former employee of Union Pacific, and Union Pacific previously notified you by letter that your name and Social Security Number may have been contained on a Union Pacific computer or Union Pacific mass storage device that was lost or stolen in a Data Breach Incident between April 1, 2006, and January 31, 2007, then you are a Class Member and may be eligible to receive a monetary benefit under this Settlement.

The Court approved the class action Settlement at the Fairness Hearing on December 7, 2007. The Settlement resolves three lawsuits in which claims were made that Union Pacific was negligent in the way that it protected its employees' confidential information, and that the Data Breach Incidents increase the risk of exposure to identity theft. Under the Settlement, Union Pacific denies that it is liable, but has agreed to make certain changes concerning that manner in which it safeguards confidential information of current and former employees. In addition, under the Settlement, any Settlement Class member who contends that he or she has incurred actual out-of-pocket damages (compensatory damages) as a result of identity theft attributable to a Data Breach Incident may elect to seek payment (a "Monetary Payment") for a portion of that Class Member's demonstrable compensatory damages through a simplified Arbitration process. To initiate an Arbitration, you must complete the Identity Theft Claim Form (PDF Document) in accordance with the instructions on that form and mail your Claim Form to the address indicated on that Claim Form no later than January 8, 2011.
